Terms of Service
Effective date: October 1, 2026
These Terms of Service ("Terms") govern your use of kemmarketing.com (the "Site") and, where referenced in a signed proposal or order, KEM Marketing LLC's ("KEM Marketing," "we," "us") services. By using the Site or engaging our services, you agree to these Terms.
Services & plans
We offer three monthly plans — Starter, Growth, and Scale — described on our Pricing page, plus one-time options (Website Build, Ad Creative Pack). Specific deliverables for your plan are as described on the Pricing page at the time you sign up, or in a signed proposal if different.
Term & cancellation
Monthly plans begin with a 90-day initial term. After the initial term, service continues month-to-month and either party may cancel with 30 days' written notice. One-time projects (Website Build, Ad Creative Pack) are billed and delivered as scoped at purchase and are not subject to the monthly term.
Fees & payment
Setup fees and monthly fees are as listed on our Pricing page at signup, except where waived under the Founding Client Program. Fees are billed in advance and are non-refundable except as required by law. Scale-plan ad spend is billed directly to you by the ad platform (Google, Meta) and is separate from our management fee.
Deliverables guarantee
If we miss a deliverable promised for a given month under your plan, we will credit that deliverable's proportional share of that month's fee. We do not guarantee search rankings, lead volume, or revenue outcomes, and nothing on this Site or in our marketing should be read as such a guarantee.
Your responsibilities
- Providing timely access to accounts, assets, and approvals needed to deliver your plan.
- Ensuring any content, claims, or offers you ask us to publish on your behalf are accurate and that you have the rights to use any photos, logos, or copy you provide.
- Complying with applicable law for your own business, including licensing and advertising rules specific to your industry.
Reviews & compliance
Review-generation services are limited to requesting honest reviews from real customers. We do not write, buy, gate, or suppress reviews on your behalf, consistent with the FTC's Trade Regulation Rule on Consumer Reviews and Testimonials (16 CFR Part 465). SMS features (including missed-call text-back) are used only where consent requirements under the Telephone Consumer Protection Act (TCPA) are met.
Intellectual property
Upon full payment, you own the final website and creative assets built specifically for you under your plan, excluding our underlying tools, templates, and any third-party licensed elements (stock photography, fonts, plugins), which remain licensed, not sold, to you for use on your site.
Disclaimers
The Site and our services are provided "as is." We make no warranty that the Site will be uninterrupted or error-free. To the maximum extent permitted by law, KEM Marketing is not liable for indirect, incidental, or consequential damages arising from use of the Site or our services.
Changes
We may update these Terms from time to time; the effective date above reflects the most recent update. Material changes affecting active clients will be communicated directly.
